Welcome to Plughorse! These Terms of Service ("Terms") govern your use of Plughorse, a service provided by Gomo AB ("we," "us," or "our"). By accessing or using Plughorse, you agree to these Terms. Please read them carefully.

By using Plughorse, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, please do not use our service.

2. Description of Service

Plughorse is an AI tutor service that provides interactive learning experiences using artificial intelligence. Parents can create accounts and invite their children to participate through anonymous profiles.

3. Eligibility

To use our service:

  • Parents: You must be at least 18 years old to create an account.
  • Children: Minors under 18 may use the service only under the supervision and responsibility of a parent or legal guardian.

4. Parental Responsibility

As a parent or legal guardian, you are fully responsible for your child's use of Plughorse. You agree to monitor their activities and ensure compliance with these Terms.

5. User Accounts

When using Plughorse:

  • Account Creation: You must provide a valid email address to register.
  • Security: Keep your login credentials confidential. You are responsible for all activities that occur under your account.
  • Account Sharing: Do not share your account with others.

6. Third-Party Services

Regarding third-party services:

  • Use of Third-Party Providers: Plughorse utilizes third-party services to operate effectively, including artificial intelligence platforms, payment processors, database management, and hosting services.
  • Service Disruptions: While we strive to maintain seamless service, we cannot be held liable for interruptions or failures caused by these third-party providers. We will do our best to mitigate any issues that arise.

7. Data Usage and GDPR Compliance

Regarding data usage and GDPR compliance:

  • Information Collected: We collect your email address, your child's nickname, age, about, goals and chat interactions.
  • Parental Consent: By using Plughorse, you consent to the collection and processing of your and your child's personal data in accordance with the General Data Protection Regulation (GDPR) and as outlined in our Privacy Policy.
  • Use of Data: Your email is used for communication purposes (updates, changes, etc.). Your child's nickname and chat interactions are used to personalize and improve the experience.
  • Data Sharing: We do not sell your data to third parties. However, your data may be processed by our third-party providers, including OpenAI, as part of delivering our service.
  • OpenAI's Terms: Our service uses OpenAI's artificial intelligence API. By using Plughorse, you also agree to OpenAI's Terms of Use, which can be found here: OpenAI Terms of Use.
  • Data Processing by OpenAI: OpenAI does not use your data to train their models unless you explicitly opt-in. Your data is processed solely to provide the AI tutor service.

8. Cookies

We use cookies to track user sessions and remember language preferences to enhance your experience. By using Plughorse, you consent to our use of cookies.

9. Subscription and Payments

  • Monthly Subscription: Plughorse operates on a monthly subscription basis.
  • No Refunds: All fees are non-refundable.
  • Payment Processing: Payments are securely processed through third-party payment providers. By subscribing, you agree to their terms and conditions.

10. Limitation of Liability

To the maximum extent permitted by law, Gomo AB shall not be liable for any indirect, incidental, or consequential damages arising from your use of Plughorse or any disruptions caused by third-party service providers.

11. Disclaimers

  • As-Is Basis: Plughorse is provided "as is" without warranties of any kind.
  • No Warranty: We do not guarantee that the service will be uninterrupted, error-free, or secure.
  • AI Limitations: The AI tutor's responses are generated by artificial intelligence and may not always be accurate or appropriate. We encourage you to evaluate the responses and supervise your child's use of the service.

12. Governing Law

These Terms are governed by the laws of Sweden. Any disputes will be resolved exclusively in Swedish courts.

13. Changes to Terms

We may update these Terms occasionally. We will notify you of significant changes via email or through the service. Continued use of Plughorse after changes constitutes your acceptance of the new Terms.
